Terms of Service

By using theretouchables.com or placing an order with us, you're agreeing to the terms below. We've written them plainly so you can actually read them. The legal weight is the same.

Who you're dealing with

The ReTouchables is operated by Talton Holdings LLC, an Oklahoma limited liability company. References to "we," "us," or "our" in these terms mean Talton Holdings LLC d/b/a The ReTouchables. References to "you" or "your" mean you, the customer.

What we do

We provide professional photo restoration services. You upload a photograph, we work on it to repair damage and improve quality, you review a proof, and after approval we deliver the finished file. That's the entire service.

Accounts

You need an account to place an order. You're responsible for keeping your password secure and for any activity under your account. If you suspect your account has been accessed without your permission, log in and change the password immediately, then message us.

You agree to provide a real name and email address. We don't allow throwaway accounts because we need to deliver work to a real person.

Pricing & payment

Pricing is published on the order page and shown again before checkout. You pay in full upfront, in US dollars, by card through Stripe.

Rush turnaround is an optional surcharge:

Rush requests are subject to availability and admin approval. If we can't accommodate a rush window, we'll offer standard turnaround or cancel the order with a full refund — your choice. No charge is collected until your rush request is approved.

Revisions & satisfaction

Every order comes with up to 3 free revision requests. After we send you the proof, you can ask for specific changes — tell us what you'd like adjusted and we'll send you a revised proof.

If after 3 revisions you're still not satisfied, you can cancel the order and receive a 50% refund of the original package price. Rush surcharges are non-refundable once work has begun, since rush capacity is allocated at the time of approval.

Refunds

Refunds are issued through Stripe to the original payment method, typically within 5–7 business days.

Intellectual property

You own your photos. We don't claim any rights to the original photographs you upload or to the restored versions we produce for you. Once we deliver the finished file, all copyright and usage rights in the restored work belong to you, just as they did with the original.

You promise that you have the legal right to send us the photos you're sending. We don't restore photographs we have reason to believe were taken or obtained illegally, or photos that depict minors in any inappropriate context. If we discover an order falls into either category, we'll cancel and refund.

Separately, we may include before/after pairs of work we do in our portfolio and marketing materials — but only with your explicit written permission. We do not use customer photos in any public-facing way unless you've said yes in writing first.

What we don't do

To be clear about scope:

Photo storage and deletion

We keep your uploaded originals and the finished restored files for as long as your account is active, so we can re-deliver work if you lose your downloaded copy. You can ask us at any time to delete them, and we will within a few business days. If you delete your account, your photos and files are removed within 30 days, except for the order-amount and date records we keep for tax purposes.

Service availability

We work to keep the site available and responsive but can't guarantee zero downtime. If extended downtime affects a time-sensitive order (a funeral, anniversary, etc.), reach out and we'll work with you to find a resolution — refund, rush of the next attempt, whatever fits the situation.

Limitation of liability

To the extent allowed by law, our total liability for any claim related to your use of this service is limited to the amount you paid us for the specific order in question. We are not liable for indirect or consequential damages — for example, lost income because a restoration wasn't ready in time, or emotional damages related to the photograph's contents.

Nothing in these terms limits liability for our own gross negligence or willful misconduct, or for any liability that legally cannot be limited.

Disputes

If something goes wrong, please reach out to us first — we'd rather work it out than fight about it. Use the contact form or the message thread on your order.

If we can't resolve it directly, these terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-laws principles. Any unresolved dispute will be brought exclusively in the state or federal courts located in Pottawatomie County, Oklahoma, and both parties consent to personal jurisdiction in those courts.

Changes to these terms

We may update these terms from time to time. If we make a material change (anything that affects your rights or our obligations), we'll post the update with a new "Last updated" date and, for active customers, send a notice by email. Continued use of the site after a change means you accept the updated version.
